Mediation and domestic abuse

A reminder that the APP7 changed at the end of last year and where the client has made an allegation of domestic violence or abuse this is no longer automatically exempted from mediation unless there has been a police investigation or application for a non-molestation or harassment order in the previous 12 months. Lawyers should be aware of this. DFSL mediators already carry out a careful assessment in relation to child protection and domestic abuse / violence so will be very aware of these issues.
